California Meal Break Rule
|
Meal break of 30 minutes to be provided after 5 hours of work, except when workday will be completed in 6 hours or less and there is mutual employer/employee consent to waive meal period. Second Meal break of at least 30 minutes to be provided after 10 hours of work, except when the total hours worked is no more than 12 hours, in which case the second meal break may be waived by mutual consent of the employer and employee only if the first meal period was not waived. If employer fails to provide the required meal break, the employer shall pay the employee 1 hour of pay at the employee's regular rate of pay (this is referred to as meal period premium pay) for each workday that the meal period is not provided. |
